1. About us
1.1. We are Whitefield Hebrew Congregation (WHC) and we own and operate this website (“Site”).
1.2. WHC is registered with the Charity Commission No. 1164798, Company No. 09031058
2. These Terms of Use
2.1. Your use of the Site is subject to these Terms of Use. By using the Site, you will be deemed to have accepted and agreed to be bound by these Terms of Use.
2.2. We may make changes to these Terms of Use from time to time. We may notify you of such changes by any reasonable means, including by posting the revised version of these Terms of Use on the Site. Your use of the Site following changes to these Terms of Use will constitute your acceptance of those changes.
2.3. These Terms of Use were last updated on 2nd February 2018.
3. Use of the Site
3.1. You are responsible for all access to the Site using your Internet connection, even if the access is by another person.
3.2. We reserve the right to restrict your access to the Site or part of it. Access to restricted areas of the Site may be subject to registration and other conditions. If we grant you permission to access a restricted area, we may withdraw that permission at any time (including where you breach any of these Terms of Use).
3.3. We will use reasonable efforts to ensure that the Site is available at all times. However, we cannot guarantee that the Site or any individual function or feature of the Site will always be available and/or error free. In particular, the Site may be unavailable during periods when we are implementing upgrades to or carrying out essential maintenance on the Site.
3.4. Access to the Site is permitted on a temporary basis and we may, at any time and for any reason, terminate your access to or use of the Site. If we terminate your access to the Site you will not have the right to bring claims against us or our officers, patrons or members with respect to such termination. We and our officers, patrons or members shall not be liable for any termination of your access to the Site.
4. Intellectual Property Rights
4.1. The intellectual property rights in the Site and all of the text, pictures, videos and other content made available on it are owned by us or our licensors.
4.2. We encourage you to download or print any of the reference material on the Site for your personal use and to draw the attention of others to material posted on the Site, save that material posted in a restricted area of the Site must only be disclosed to those permitted to access that area.
4.3. Our status (and that of any identified contributors) as the authors of material on the Site must always be acknowledged.
4.4. You must not modify any part of the materials on the Site or use any of the materials for commercial purposes.
4.5. If you print off, copy or download any part of the Site in breach of these terms of use, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
5. Liability
5.1. We provide the Site on an ‘as is’ basis and make no representations as to the quality, completeness or accuracy of any content made available on the Site. Neither WHC nor any of its officers, patrons or members will be responsible, or liable to you or to any third party, for the content or accuracy of any materials posted on or accessible via the Site.
5.2. The views expressed in the articles, reports, reviews and other contributions to the Site are those of the authors and do not necessarily reflect the views of the officers, patrons or members of WHC.
5.3. We aim to update the Site regularly, and may change the material on it at any time. Any of the material on the Site may be out of date at any given time, and we are under no obligation to monitor its accuracy or to update such material
5.4. To the maximum extent permitted by law, we expressly exclude for us, and as agent for and for the benefit of, our officers, patrons or members:
5.4.1. all conditions, warranties and other terms that might otherwise be implied into these Terms of Use by statute, common law or the law of equity; and
5.4.2. any and all liability to you, whether arising under these Terms of Use or otherwise in connection with your use of the Site.
5.5. The foregoing is a comprehensive limitation of liability that applies for us, and for the benefit of, our officers, patrons or members to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties and whether caused by tort (including but not limited to negligence), breach of contract or otherwise, even if foreseeable.
5.6. Notwithstanding the foregoing, nothing in these Terms of Use is intended to exclude or limit any liability that may not by law be excluded or limited, and in particular none of the exclusions and limitations in this clause are intended to limit any rights you may have as a consumer under local law or other statutory rights which may not be excluded, nor in any way to exclude or limit (site owner) liability to you for death or personal injury resulting from our negligence or that of our employees or agents.
6. Lawful Use
6.1. Your use of the Site is conditional on your compliance with the following rules of conduct. You agree that you will not:
6.1.1. use the Site for any fraudulent or unlawful purpose;
6.1.2. use the Site to defame, abuse, harass, stalk, threaten or otherwise violate the rights of others, including without limitation others’ privacy rights or rights of publicity;
6.1.3. impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Site; or express or imply that we endorse any statement you make;
6.1.4. reproduce, duplicate, copy, sell, resell, or otherwise exploit for any commercial purposes, any portion of, use of, or access to the Site;
6.1.5. modify, adapt, translate, reverse engineer, decompile or disassemble any portion of the Site. If you wish to reverse engineer any part of the Site to create an interoperable program you must contact us and we may provide interface data subject to verification of your identity and other information;
6.1.6. remove any copyright, trade mark or other proprietary rights notice from the Site or materials originating from the Site;
6.1.7. frame or mirror any part of the Site without our express prior written consent;
6.1.8. create a database by systematically downloading and storing Site content;
6.1.9. use any manual or automatic device in any way to gather Site content or reproduce or circumvent the navigational structure or presentation of the Site without our express prior written consent.
6.2. Notwithstanding the foregoing, we grant the operators of public online search engines limited permission to use search retrieval applications to reproduce materials from the Site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of such materials solely in connection with each operator’s public online search service. We reserve the right to revoke these exceptions either generally or in specific instances.
7. Viruses, Hacking and Other Offences
7.1. You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack.
7.2. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We may report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.
7.3. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any material posted on it, or on any website linked to it.
8. Links
8.1. The Site may provide links to other websites and online resources. We are not responsible for and do not endorse such external sites or resources. Your use of third party websites and resources is at your own risk.
8.2. You may create a link to this Site, provided that:
8.2.1. the link is fair and legal and is not presented in a way that is: (a) misleading or could suggest any type of association, approval or endorsement by us that does not exist, or (b) harmful to our reputation or the reputation of any of our officers, patrons or members;
8.2.2. you retain the legal right and technical ability to immediately remove the link at any time, following a request by us to do so;
8.2.3. the link will not cause this Site or any content on this Site to be: (a) embedded in or ‘framed’ by any other website, or (b) otherwise displayed in a way different to the way originally intended by us.
8.3. We reserve the right to require you to immediately remove any link to the Site at any time and you shall immediately comply with any request by us to remove any such link.

10. Rights of Third Parties
10.1. Pursuant to the Contracts (Rights of Third Parties) Act 1999, WHC and its officers, patrons and members shall be entitled to enforce those provisions of these Terms of Use which purport to confer a right or benefit upon them.
11. Trade Marks
11.1. We reserve all rights to the trade mark and trading names and styles “WHC” and “Whitefield Hebrew Congregation”.
12. Governing Law
12.1. These Terms of Use will be governed by and construed in accordance with the laws of England, and the courts of England will have non-exclusive jurisdiction over any claim or dispute arising under or in connection with these Terms of Use.
